These terms are an agreement between you and HigglersLab Solution Private Limited (“Higglers Lab”, “we”) for the Sculpt3D apps for iPhone, iPad and Mac (the “App”) and the website sculpt3d.in. By installing the App or using the site, you agree to them.
1. Your licence
We grant you a personal, non-exclusive, non-transferable licence to install and use the App on devices you own or control, for personal or commercial work. You may not resell, sublicense or redistribute the App, or remove its notices.
If you got the App from the Apple App Store, Apple’s Licensed Application End User License Agreement also applies, together with the Apple terms in section 10. Where it conflicts with these terms, these terms apply to the extent the App Store rules allow.
2. Your models are yours
You own everything you create with Sculpt3D: sketches, models, drawings and exported files. We claim no rights in them and never receive them; see the Privacy Policy.
3. Acceptable use
Please don’t:
- use the App or site to break the law or infringe anyone else’s rights, including their designs or trademarks;
- reverse engineer the App except where the law expressly allows it, or bypass its technical protections;
- interfere with the website, flood the download form, or try to reach parts of it not meant for you.
4. Open-source components
Sculpt3D is built on Open CASCADE Technology and other open-source software, each under its own licence. Nothing in these terms limits your rights under those licences.
5. Engineering responsibility
Sculpt3D is a design tool. You are responsible for checking that your models, dimensions and exported files are accurate and fit for your purpose before you manufacture, print, sell or rely on anything made from them, especially where safety is involved.
6. Betas and updates
Pre-release versions, including TestFlight builds and direct downloads, may be incomplete, change without notice or stop working. Keep backups of important work. We may update, change or discontinue features, and may offer paid features in future; we will tell you before anything you already use starts to cost money.
7. No warranty
The App and site are provided “as is” and “as available”, without warranties of any kind, whether express or implied, including fitness for a particular purpose, accuracy and non-infringement, to the fullest extent the law allows. Some places do not allow these exclusions, so they may not all apply to you.
8. Limit of liability
To the fullest extent the law allows, Higglers Lab is not liable for indirect, incidental, special or consequential losses, or for lost data, profits or business, arising from your use of the App or site. Our total liability for any claim is limited to the amount you paid us for the App in the 12 months before the claim, or INR 1,000 if you paid nothing. Nothing here limits liability that cannot legally be limited.
9. Ending these terms
You can stop at any time by deleting the App. If you seriously breach these terms, your licence ends automatically. Sections 2, 5, 7, 8 and 11 survive.
10. Apple
For copies obtained through the App Store: these terms are between you and Higglers Lab, not Apple. Apple has no obligation to provide maintenance or support, and is not responsible for any product claims, third-party intellectual property claims or legal compliance relating to the App; we are, as these terms describe. If the App fails to meet an applicable warranty, you may notify Apple for a refund of any purchase price, and Apple has no other warranty obligation. You confirm you are not in a country under a U.S. Government embargo or on a U.S. Government restricted-party list. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
11. Law and disputes
These terms are governed by the laws of India. The courts at Thanjavur, Tamil Nadu have jurisdiction, without removing any protection you have under the consumer laws of the country where you live.
12. Changes
We may update these terms. We will change the date above and, for significant changes, give notice on this site before they take effect. Continuing to use Sculpt3D after that means you accept the new terms.
